Five accused of malfeasance in Konstruktor remain free pending further proceedings

SPLIT, Nov 28 (Hina) - Five men, accused of malfeasance during the privatisation of the Split-based Konstruktor company, will not be arrested as in this case there are no grounds for pre-trial detention, the Split county office of the Chief State Prosecutor reported on Saturday evening.

The county office of the Chief State Prosecutor reported on its web site earlier in the day that five men were charged with abuse of office and malfeasance during the privatisation the local construction company from April 1992 to the end of 1996, giving only the initials and the years of birth of the suspects.

According to the media, two high-profile suspects in this case are Konstruktor Director Zeljko Zderic and the current head of the tax administration, Ivica Mladineo.

At the time relevant for the case, Zderic was the chairman of the socially-owned enterprise Konstruktor while Mladineo and the other three men were member of the managing board of the enterprise.

They are charged with having prevented the completion of the process of the privatisation of that construction company and with having established a new company to which they transferred Konstruktor's shares which should have been sold to employees - small shareholders. As a result, they embezzled over HRK 2 million from the Croatian Privatisation Fund.

The five suspects can appeal against the charges within eight days after they were pressed against them.

Upon the expiry of this eight-day deadline the Split County Court is expected to decide whether the indictment is valid.
