Committee won't ask Constitutional Court about marriage referendum

ZAGREB, Nov 12 (Hina) - The parliamentary Gender Equality Committee on Tuesday rejected a conclusion to ask the Constitutional Court to assess the constitutionality of parliament's decision to call a marriage referendum.

The conclusion, which received two votes in favour and five against, was moved by committee chair Nansi Tireli of the Labour Party based on last week's demand by LGBT groups to stop the referendum on the constitutional definition of marriage as a heterosexual union.

The conclusion was supported by Tireli and Sonja Koenig of the Croatian People's Party, a junior partner in the ruling coalition. The ruling Social Democratic Party's (SDP) members were against it.

Koening said the referendum requested by the "In the Name of the Family" initiative was "senseless, inhuman, anticonstitutional, dangerous, unjustified and discriminatory."

She said that under the constitutional law on the Constitutional Court, the committee could ask the Court to take a stance on parliament's decision and that it was "our duty and obligation" to ask the Court to do so as soon as possible.

Melita Mulic of the SDP said the committee must not derogate parliament's decision to call the referendum nor the constitutional law on the Constitutional Court, which she said stipulated that parliament was the only body authorised to ask the Court to assess the constitutionality of the decision.

Tireli recalled that LGBT associations asked the committee to prevent parliament from calling the referendum or to ask the Constitutional Court to take appropriate measures as to the constitutionality and legality of the referendum.
