ZAGREB, 6 Feb (Hina) - Croatia's ombudsman Ante Klaric on Friday
recommended the Croatian government rescind its Regulation on
Renting State-Owned Flats in the Croatian Danube River Region.
According to Klaric, with the Regulation the Government
overstepped its authority by 'suspending legal provisions which
are at a higher legal level than a regulation'.
According to Article 83 of the Croatian Constitution, the subject
of the disputed regulation is exclusively under the jurisdiction of
the Croatian National Parliament.
"The Government cannot suspend individual legal provisions of any
law adopted by the Croatian National Parliament with a regulation -
that can be done only by Parliament, in line with the same procedure
which is used when a law is adopted," Klaric said.
The regulation should therefore be rescinded.
A bill aimed at regulating and solving the question of housing and
the legal regime of use of state-owned flats in the Croatian Danube
River region should be prepared for the next parliament session,
Klaric said in his recommendation.
