With ten votes in favour and two against, Constitutional Court judges decided that the existing provisions of the Law on Pension Insurance which make a difference between men and women regarding the right to old-age pension constituted a violation of gender equality, however, given the complexity of the problem and European practice, they decided that this provision should be changed in the next eleven and a half years.
A number of judges underlined that the ruling of the Constitutional Court did not determine the retirement age to go into force in 2019, nor did it bind women to work until they are 65, as is now the case with men.
Judge Jasna Omejec said that the ruling only stated that this case of gender inequality had to be solved and that the methods of solving it were within the jurisdiction of lawmakers, who are to determine the retirement age.
The Constitutional Court ruling was criticised by women's associations, which said that it equalized obligations, but not rights, as well as by some nonparliamentary leftist parties.
