Cermak was ordered to return to The Hague on 8 February to attend a status conference on potential conflict of interest of some defence lawyers in the "Gotovina, Cermak and Markac" case and on allegations that he had breached conditions of his provisional release.
Although the trial chamber found that Cermak had violated the provisional release rules, it took into account his cooperation with the ICTY and decided on Thursday to release him pending trial.
Last month the Zagreb weekly Globus reported that Cermak had violated the provisional release rules three times. At the end of December 2006 Cermak attended a birthday party and a New Year's Eve party in Zagreb, while in January 2007 he attended a skiing race on Mount Sljeme overlooking Zagreb, which Globus documented with photographs.
A trial in the case of Cermak and two other Croatian Army generals, Ante Gotovina and Mladen Markac, is scheduled to open on May 7.
