ZAGREB/THE HAGUE, Jan 18 (Hina) - A trial chamber of the Hague war crimes tribunal has requested a prompt response from the Croatian government and defence counsel for General Ivan Cermak on whether Cermak is fully observing the conditions of his provisional release.

The Trial Chamber in the case urged the government to submit by January 23 any additional information on Cermak's compliance with the provisional release conditions in December 2006, on measures taken by the government to ensure compliance with those conditions, as well as on measures taken by the government in line with its obligations as defined in the Appeals Chamber's decision on provisional release.

The request of the Trial Chamber was sent to the government, defence counsel for Gen. Cermak, defence counsel of the other two generals indicted in the same case, as well as to the prosecution of the Hague tribunal.

Cermak's defence is bound by the request to submit its position by January 23, and the Hague prosecution and attorneys for the other two generals - Ante Gotovina and Mladen Markac - have been requested to submit their positions if they want to.

Globus weekly last Wednesday said that Cermak had violated the tribunal's rules by leaving his home three times and that therefore he should be put back in custody.

Between December 29, 2006 and January 4, 2007, Cermak attended a birthday party and a New Year's Eve party in Zagreb and a skiing race on Mount Sljeme overlooking Zagreb, Globus wrote, publishing photos to prove its claims.

Cermak and the two other generals, Gotovina and Markac, are charged with crimes committed against Serbs during and in the wake of military operation "Storm" in the summer of 1995. Their trial is set to open on May 7.

In its request to the government and parties concerned the Trial Chamber pointed to the press articles and photos submitted to it by the ICTY Registrar. The Trial Chamber recalls in its request that in its December report the government had failed to include information on Cermak that was submitted by the Registrar.

The Trial Chamber recalled that under the conditions defined by the Hague tribunal, Cermak may stay in Krapinske Toplice as his place of residence, Zagreb as the seat of his business enterprise, and Dubrovnik as a place of vacation.

After the publication of photos, Cermak's defence counsel said that their client was not violating any of the conditions on provisional release set by the Hague tribunal.

Cermak surrendered voluntarily to the Hague tribunal on 11 March 2004 and was released pending trial in December 2004.
