ZAGREB, Jan 25 (Hina) - The Constitutional Court today passed its
first "eviction" verdict, ruling in favour of the tenant, M.B. from
Zagreb, who had received an eviction order signed by the Housing
Ministry.
The plaintiff exchanged her Belgrade flat for a former JNA
(Yugoslav army) flat in Zagreb in 1991.
The ruling quashed all previous eviction orders signed by the
Housing Ministry on the grounds that administrative bodies were not
competent in the matter.
Under the Courts Act, property-rights relations lay within the
competence of the courts, the verdict said.
The Housing Ministry was acting on behalf of the Defence
Ministry, which took over former JNA flats under a Government
Decree of Oct 3, 1991.
The Constitutional Court has so far passed 51 decisions
suspending evictions during constitutional proceedings against
Article 94 of the Housing Act.
