use its Tuesday summit in Madrid to compel the Federal Republic of
Yugoslavia to comply with international law and obligations to the
ICTY and the PIC.
ICTY president Gabrielle Kirk McDonald forwarded a letter to the
PIC, pointing to the fact that the Yugoslav government was not
complying with its obligations to the ICTY.
McDonald wrote in the letter that Yugoslavia's repeated refusal to
arrest Mile Mrksic, Veselin Sljivancanin, and Miroslav Radic,
accused of war crimes in the eastern Croatian town of Vukovar,
represented the most obvious example of refusing cooperation with
the ICTY.
She emphasised the refusal was typical of Yugoslavia's attitude to
the tribunal since the tribunal's establishment in May 1993.
Since September when she briefed the United Nations Security
Council on Yugoslavia's attitude, McDonald said Yugoslavia's non-
cooperation had turned into obstructive behaviour.
Yugoslavia on November 5 notified the prosecutor it did not accept
ICTY's right to conduct investigations on its territory, McDonald
also recalled.
