ZAGREB, Dec 3 (Hina) - I believe I did not commit the crime of
disclosing a business secret. In a civilised world the bank account
of the President and his family cannot be a business secret," Ankica
Lepej told Zagreb County Court investigative judge Zeljko Horvatic
on Thursday.
Based on inquiry requests submitted by the Zagreb County State
Attorneys Office for disclosing and obtaining business secrets,
Robert Horvat and reporters of the "Jutarnji List" daily, Orlanda
Obad and Andreja Koscec, were also heard by the judge.
Lepej's defence attorney, Vesna Alaburic, held that this case was
certainly one of disclosing a business secret as put by the Law on
Banks and bank business, but not as set by the Criminal Law.
She stressed that there were a number of elements that had not been
fulfilled in order for the case to be considered a crime of
divulging a business secret.
Ankica Lepej, a long-term employee of the Zagrebacka Banka,
disclosed to the public the state of account of the Croatian
President's wife, Ankica Tudjman.
Horvat, also an employee of the bank, confirmed to reporter Orlanda
Obad the information that Tudjman had made a fixed-term deposit of
DM210,000 and US$15,740.
This information was published in "Jutarnji List" on October 17.
The Zagrebacka Banka filed charges against Lepej and Horvat after
it had offered a reward of one million kuna to whoever provided
information about who had disclosed the account information.
Ankica Lepej reported herself to the bank's management two days
after.
Both have been fired.
If they are convicted, they could be sentenced to one to five years
in prison.
