NEW YORK, Nov 8 (Hina) - The length and complexity of procedures on one side and certain countries' failure to cooperate on the other are some of main problems the International Criminal Tribunal for the former Yugoslavia (ICTY) is
facing in its work, ICTY President Gabrielle Kirk McDonald said on Monday. "Radovan Karadzic and Ratko Mladic were indicted in 1995 and Slobodan Milosevic was indicted earlier this year. Yet, these individuals remain at large. Their liberty makes a mockery of our pledge to would-be tyrants that they will be indicted, arrested and made to answer for their alleged criminal acts and violations of human rights", Kirk McDonald said. She believes that the Tribunal's principle responsibility is to bring to justice those individuals whose presence impedes the establishment of civil society in former Yugoslavia. Kirk McDonald also welcomed the new policy of the ICTY Prosecutor Carla del Ponte that in the

She believes that the Tribunal's principle responsibility is to
bring to justice those individuals whose presence impedes the
establishment of civil society in former Yugoslavia. Kirk McDonald
also welcomed the new policy of the ICTY Prosecutor Carla del Ponte
that in the future she would focus on leadership investigative
targets.
Kirk McDonald stressed that over 30 of the individuals publicly
indicted by the Tribunal remained at large.
"I have the duty to inform you that the important work of the
Tribunal is being hindered by non-compliance of the Federal
Republic of Yugoslavia, the Republic of Croatia, and the Republika
Srpska" the ICTY president said.
She reiterated problems regarding the extradition of Mladen
Naletilic Tuta, and Croatia's failure to recognise Tribunal's
jurisdiction in the military and police operations of "Storm" and
"Flash".
Kirk McDonald said that the UN Security Council had been informed of
non-compliance of the countries with the ICTY on several occasions,
however, the Security Council failed to give a forceful response.
According to her, "the ICTY lacks independent coercive mechanism
and relies to adopt effective measures to compel mate
cooperation".
