CONSTITUTIONAL COURT REVOKES PROVISION ON LIMITING RIGHT TO STRIKE IN POWER SUPPLY INDUSTRY

ZAGREB, Oct 5 (Hina) - The Croatian Constitutional Court on Tuesday revoked a Power Supply Law provision which limits the constitutional right to strike. The decree authorises the competent minister, in case of strike and to protect Croatia's interests and security, to regulate the volume of functioning of the power supply system. The decree authorises the competent minister, in case of strike and to protect Croatia's interests and security, to regulate the volume of functioning of the power supply system. The same decree authorises the director of the public power supply company to regulate which tasks must be carried out, and stipulates that the employee who fails to execute the director's order be dismissed. The Constitutional Court's position is that conditions limiting the right to strike could be regulated by law, but also that these conditions ought to in no case significantly limit or completely deny the right. The Constitution stipulates that rights and freedoms can be limited only by law in order to protect other people's freedom and rights, and the constitutional order, public morality and health. The Constitutional Court points out the contentious Power Supply Law provision is not in keeping with regulations of the European Convention on the Protection of Human Rights and Basic Freedoms, the International Pact on Economic, Social, and Cultural Rights, and the International Pact on Civic and Political Rights.
