ZAGREB, Feb 2 (Hina) - The Union of Croatian Railway Workers (SHZ)
on Tuesday requested that the Constitutional Court investigate
whether Article 16 of the Law on Changes to the Law on Croatian
Railways (HZ) is constitutional and legal.
The Union believes that the law in question is being used for anti-
constitutional limitation of the right to strike.
Article 16 enables the Management to limit the right to strike with
the aim of securing minimum transport of passengers and goods as
well as the maintenance of railway equipment during strikes, Union
representatives told reporters in Zagreb on Tuesday.
According to the Constitution, the right to strike can be limited in
armed forces, police and public services. According to the law on
HZ, only passenger transport and maintenance of railway equipment
is a public service but not transport of goods.
Therefore the regulations on limiting the right to strike cannot
apply to freight transport, the Union believes.
