ZAGREB, Dec 17 (Hina) - The Zagreb County Court on Monday dismissed
as unfounded a request for an investigation into Vladimir Gredelj,
the president of the Bjelovar County Court and the Croatian Judges'
Association, which had been filed by the Bjelovar county state
prosecutor's office.
The Bjelovar county state prosecutor's office has accused Gredelj
of abuse of position and office and instigation to abuse office, and
suspects three employees of the Croatia Osiguranje insurance
company whom Gredelj allegedly instigated to do so.
According to the Zagreb County Court, the data and evidence
submitted with the investigation request do not justify the
conclusion that there is ground to assume the suspects committed
the crimes alleged by the county state prosecutor's office.
The Zagreb County Court maintains it cannot accept the prosecutor's
office claim that Gredelj used the Bjelovar County Court's official
vehicle for personal purposes. In its decision, the Zagreb County
Court states that financial documentation copies show the entire
mileage on court vehicles corresponds to travel or other court
warrants, which points to the non-existence of evidence indicating
that Gredelj committed the crime.
The Zagreb County Court further states that Bjelovar County Court
funds were indeed used to purchase a contentious Milan Dracija
painting, but that this conduct on Gredelj's part does not
represent a crime, namely, it does not indicate that Gredelj
exceeded his authority to help another party make illegal gain. The
Zagreb County Court maintains that as court president, Gredelj is
the only party authorised to manage court funds, and that the county
state prosecutor's office does not possess data indicating that
Gredelj committed a crime.
The Zagreb County Court established that the Bjelovar County Court
and Croatia Osiguranje signed a motor-car insurance contract
covering several years, and that the investigation request does not
state specific data as to how Gredelj supposedly influenced other
suspects to commit crime.
The Bjelovar county state prosecutor's office has three months to
appeal the Zagreb County Court decision with the Supreme Court.
