against General Pavle Strugar, Strugar's attorneys, Goran Rodic

Strugar was indicted of grave violations of the rights and customs
of war in conflicts in the Dubrovnik area which lasted from October
1991 until October 1992.
Strugar's attorneys said they contested the jurisdiction of the
tribunal in relation to the application of additional Geneva
Convention protocols, the international character of conflicts in
Dubrovnik, and pointed out formality insufficiencies of the
indictment.
The tribunal's president, Claude Jorda, formed a special appeals
council which will make a final decision on the tribunal's
jurisdiction over the additional protocols.
"The trial chamber yesterday adopted arguments of the defence
attorneys and ordered the Prosecution to, within 15 days, write up a
new indictment with harmonised facts pertaining to the date of
Croatia's international recognition, and the dispute surrounding
the international character of the conflicts in Dubrovnik," Rodic
said.
"The prosecutor must state exactly which buildings in Dubrovnik's
Old Town were damaged, from where the attacks came, who carried them
out, the extent of the damage and how exactly it occurred, and
whether Strugar played any part in the alleged attacks," Rodic
said.
