ZAGREB, Feb 25 (Hina) - The Committees on the Constitution and Rule Book and on Legislation decided at a joint thematic session on MPs' immunity on Monday that the parliament would approve MPs' being stripped of immunity, i.e. being
prosecuted, as a rule, if so requested by the State Prosecution, and not approve it if that is requested by a complainant. Today's decision confirms the current practice of stripping MPs of immunity if so requested by the State Prosecution. It has been concluded, however, that this will not be done automatically but depend on whether the State Prosecutor protects the country's legal order with his request. In case a request for stripping an MP of immunity is submitted due to a private lawsuit for offence and slander, the request will not be accepted as a rule, as has been the case so far, with the exception of private lawsuits referring to an offence agains

stripped of immunity, i.e. being prosecuted, as a rule, if so
requested by the State Prosecution, and not approve it if that is
requested by a complainant.
Today's decision confirms the current practice of stripping MPs of
immunity if so requested by the State Prosecution. It has been
concluded, however, that this will not be done automatically but
depend on whether the State Prosecutor protects the country's legal
order with his request.
In case a request for stripping an MP of immunity is submitted due to
a private lawsuit for offence and slander, the request will not be
accepted as a rule, as has been the case so far, with the exception
of private lawsuits referring to an offence against public morals
or larger groups of citizens.
As has been the case so far, MPs will not be stripped of immunity for
expressing their opinions as this is the main reason for granting
them constitutional protection in the form of immunity.
