CONSTITUTIONAL COURT SETS FINES DUE TO LENGTHY PROCEEDINGS

ZAGREB, May 2 (Hina) - The Constitutional Court has ruled in favour of two complaints about the length of court proceedings and ruled that parties be given compensation of 5,000 and 6,000 kuna (EUR661 and EUR793). The court dismissed one complaint because it was established that the party had contributed to the length of the court process with his conduct.

The court dismissed one complaint because it was established that the party had contributed to the length of the court process with his conduct. #L# The relevant period for the Constitutional Court to determine that proceedings are too lengthy is from November 1997 when by entering the European Union, Croatia bound itself to protect the right to a fair trial within a reasonable time frame, as one of the basic human rights. The court's judges will take into consideration a date before this time frame only in exceptional cases, i.e. if proceedings are drastically long. Such has also been the practice of the European Court of Human Rights in Strasbourg. (hina) lml sb
