THE HAGUE/ZAGREB, March 24 (Hina) - A hearing in the case against former Yugoslav president Slobodan Milosevic will be held before the International Criminal Tribunal for the former Yugoslavia (ICTY) on Thursday at which the defendant is expected to say whether or not he agrees to the continuation of the trial with a new presiding judge, to replace Judge Richard May who resigned due to health reasons.
THE HAGUE/ZAGREB, March 24 (Hina) - A hearing in the case against former Yugoslav president Slobodan Milosevic will be held before the International Criminal Tribunal for the former Yugoslavia (ICTY) on Thursday at which the defendant is expected to say whether or not he agrees to the continuation of the trial with a new presiding judge, to replace Judge Richard May who resigned due to health reasons.#L# Under the ICTY Rules of Procedure and Evidence, in order to continue the trial with a new member of the Trial Chamber in an advanced stage of proceedings, as it is the case in the Milosevic trial, the defendant's consent is required, otherwise there might be a retrial. However, there is an exception to this rule, namely the trial may continue even without the consent of the defendant should the trial chamber decide that this is in the interest of justice.
