ZAGREB, Jan 26(Hina) - The Croatian Constitutional Court decided on Monday that all 12 Administrative Court rulings on the basis of which the Osijek County Assembly had been dissolved for early elections, were in violation of the
Constitution.
ZAGREB, Jan 26(Hina) - The Croatian Constitutional Court decided on
Monday that all 12 Administrative Court rulings on the basis of which
the Osijek County Assembly had been dissolved for early elections,
were in violation of the Constitution.#L#
Given that the 30-day period the Constitutional Court has to assess
the January 18 elections has not yet expired, the polls might be
contested because they were preceded by unconstitutional rulings,
which would be the first such case in the Constitutional Court's
practice.
The Constitutional Court established that the 12 rulings whereby the
Administrative Court quashed 12 decisions adopted by the County
Assembly were arbitrary as they deviated from regular practice and
disregarded or wrongly interpreted the existing rules.
The Constitutional Court published its decision on its web page today
as part of its new practice to promptly publish rulings from sessions
closed to the public.
