ICTY prosecutors want to amend indictments against four Croatian journalists

THE HAGUE/ZAGREB, July 15 (Hina) - The Office of the Prosecutor of the Hague-based International Criminal Tribunal for the former Yugoslavia (ICTY) has filed a motion for leave to amend the indictments against Croatian journalists Domagoj Margetic, Stjepan Seselj, Ivica Marijacic and Markica Rebic in order to "clarify both factual and legal aspects to the case".

The motion, a copy of which Hina obtained on Friday, says that the proposed amendments are "of a relatively restricted nature" and "do not constitute new charges against the accused." The motion is dated 7 July 2005.

Marijacic, editor-in-chief of the Hrvatski List weekly, Rebic, the weekly's contributor and former intelligence agent, and Seselj and Margetic, publisher and former editor-in-chief of the Hrvatsko Slovo weekly respectively, were charged with contempt of court on 26 April for publishing the testimonies of two protected witnesses in the Tihomir Blaskic trial and for revealing their identities.

On 14 June, at their initial appearance before ICTY judges in The Hague, the four accused pleaded not guilty, and their defence counsel filed motions to dismiss the indictments.

The Office of the Prosecutor has asked the trial chamber in the case to reject the defence motions to dismiss the indictments, arguing that "the Tribunal has jurisdiction over any person who knowingly or wilfully interferes with the administration of justice."

"The Tribunal has personal and subject matter jurisdiction over anyone who knowingly or wilfully interferes with its administration of justice," the Office of the Prosecutor said in its response to the defence motions dated 28 June 2005, a copy of which Hina obtained on Friday.
