Croatia's cooperation can't be described as full - del Ponte, Meron report

ZAGREB, June 7 (Hina) - In her new report to the UN Security Councilreleased on Tuesday, ICTY chief prosecutor Carla del Ponte saidCroatia's cooperation with the Hague tribunal, "for the time being...cannot be described as full," despite the promising start of theimplementation of an action plan to track down fugitive General AnteGotovina.
ZAGREB, June 7 (Hina) - In her new report to the UN Security Council released on Tuesday, ICTY chief prosecutor Carla del Ponte said Croatia's cooperation with the Hague tribunal, "for the time being... cannot be described as full," despite the promising start of the implementation of an action plan to track down fugitive General Ante Gotovina.

Also today, the UN released on its web pages the report of ICTY President Theodor Meron, who said that the status of cooperation with Croatia "remains the same as last reported," namely "good except for the arrest and transfer of Ante Gotovina".

Meron and del Ponte will read their reports before the Security Council on June 13.

In del Ponte's report, Croatia's cooperation with the ICTY Prosecution is covered in two differently worded chapters, the first relating to the period before and the second after the action plan to locate Gotovina went into force.

In the first chapter, del Ponte regrets that since her last address to the Security Council on 23 November 2004, "not much progress can be reported on the efforts made by the Croatian authorities... to locate, arrest and transfer Ante Gotovina. These efforts were neither focused, nor convincing".

The chief prosecutor also doubts "the genuine willingness" of the Croatian authorities to arrest the fugitive, and says that Zagreb preferred voluntary surrender as an option.

Del Ponte also mentions a number of incidents where "sensitive information was manipulated so as to obstruct the investigation against Gotovina and his protective networks". She also mentions media campaigns, "sometimes based on confidential documents leaked to the press or on a twisted interpretation of court documents, which tried to discredit the International Criminal Tribunal for the former Yugoslavia or its partners in Zagreb".

"This indicates that the networks supporting Gotovina within the institutions remain well and active, and no decisive move has been made against them," says del Ponte.

The second chapter covers the government's action plan to locate the fugitive, which went into force on April 26.

"The Croatian Government has now made new promises, and an action plan has been designed. If carried out with the necessary resolve, this action plan has the potential to hit hard at Gotovina's support networks and provide detailed intelligence about the fugitive's whereabouts," reads the report.

"This may be the beginning of a serious operation. However, a definite assessment cannot take place immediately. It will take three to four months to evaluate whether, this time, finally, Croatia is doing everything it can to locate and arrest Gotovina. If the Croatian authorities show the necessary determination, then either Gotovina should be brought to The Hague or the Croatian authorities should provide all detailed information that can lead to his arrest. For the time being, however, cooperation cannot be described as full," del Ponte concluded.

In his report, ICTY president Meron said "it is of major concern that this last remaining stumbling block to achieving full cooperation with the Tribunal has not yet been settled".

"It is imperative that Gotovina appear before the Tribunal. I am very concerned at the continuing failure of the Government of Croatia to ensure the arrival of Ante Gotovina at the Tribunal," said Meron.

Del Ponte and Meron dedicate most of their reports to the implementation of the ICTY's exit strategy over the past six months and prospects of meeting it in the next six.
