Doctors to go on strike Monday despite court ban

ZAGREB, April 8 (Hina) - The Zagreb County Court on Friday banned the strike of doctors which the Croatian Doctors' Union (HLS) had announced for Monday, April 11, but the HLS said it would start the strike on Monday regardless.

The complaint against the HLS seeking a ban on the strike had been filed by the Health and Social Welfare Ministry.

Judge Dubravka Burcar said the strike had been banned because there were no legal conditions to allow it.

The strike had been announced due to disregard for the collective agreement for health workers of December 8, 2004, and the refusal by the Economic and Social Council (GSV) to recognise the results of a referendum held by doctors on January 5, 2005, which was a precondition for the collective agreement to go into force.

The collective agreement did not go into force because the GSV on January 18 decided not to recognise the results of the referendum, Burcar said.

She said that the HLS could appeal to the Supreme Court, which is bound to rule on the complaint in five days' time.

HLS president Ivica Babic told Hina that the union would use all legal means and would appeal against the ban and that the strike would start on Monday as announced.

He added that the union would respect the court ruling on the ban if and when it became final.
