ZAGREB, Jan 7 (Hina) - Boris Miksic, an independent presidential candidate who ran in the first round of the Croatian presidential elections last Sunday and who came in third, said on Friday that he would abide by but that he did not agree with the rulings of the Constitutional Court which turned down his complaint about him being unable to have monitors at the elections and his request for the recount of votes.

Miksic said that he would find ways to prove before international courts that the January 2 presidential election was unlawful.

At a previous news conference Miksic apologised for his behaviour after the polling stations were closed on Sunday stating that he might have overreacted and that his comparison of Croatia and the situation in Ukraine was not good.

Miksic, a successful businessman in the United States who recently returned to Croatia, said that he had responded to a suggestion by the current President Stjepan Mesic and on Thursday tendered his irrevocable resignation as Croatia's honorary consul in St. Paul, the United States.

Commenting on Mesic's statement that in the January 16 run-off he counted on the votes of those who voted for Miksic in the first round, Miksic said that his voters "are too intelligent to vote for Mesic".

Miksic criticised Mesic for promising new models of production and new technologies although he, Miksic said, "hasn't got a clue about technology".

Miksic, who won 17.79 percent of votes in the first round and was third after Mesic (48.92 percent) and Jadranka Kosor (20.30 percent), said that he based his claims about election irregularities and his winning 20 percent of the vote on exit polls that were conducted by two opinion poll agencies and broadcast by two television networks (HTV and Nova) during the entire evening after the polling stations were closed. According to those projections, Miksic was likely to come in second and possibly compete with Mesic in the second round.

According to the official results issued by the State Election Commission, Miksic was not second but third in the first round of the polls. The run-off will be held on 16 January, as the first candidate, President Mesic, failed to win 50 percent plus one vote, which would have made him the winner of the 2 January election. Mesic's rival is the candidate of the ruling Croatian Democratic Union (HDZ), Jadranka Kosor.
