Croatian Constitutional Court says national television did not break law

ZAGREB, Jan 5 (Hina) - The Croatian Constitutional Court ruled onWednesday that the national broadcasting corporation HRT did not breakthe law when it broadcast the results of an opinion poll aboutpresidential candidates in its prime-time news programme on December31, saying that a 48-hour electioneering ban was not in effect at thetime.
ZAGREB, Jan 5 (Hina) - The Croatian Constitutional Court ruled on Wednesday that the national broadcasting corporation HRT did not break the law when it broadcast the results of an opinion poll about presidential candidates in its prime-time news programme on December 31, saying that a 48-hour electioneering ban was not in effect at the time.

Presidential candidates Doris Kosta, Slaven Letica, Ljubo Cesic and Miroslav Rajh sent a joint letter to the Constitutional Court on January 1, the day before the presidential election, saying that the report containing the results of the opinion poll was suggestive.

The four candidates said that the HRT report, broadcast just hours before the electioneering ban took effect at midnight on December 31, violated the right of all the presidential candidates to equal status, because it favoured one candidate.

The Constitutional Court said it was not competent to decide on a request by the four candidates that the presidential election should be suspended and postponed for at least six weeks and that leading people at the HRT should explain why the report was broadcast and that they should resign.
