A team of three prominent experts, psychiatrists, have established that Asner is unfit for trial, officials at the Austrian ministry said.
The Pozega County Prosecutor's Office is not familiar with the assessment of Austrian experts, whose opinion had been requested by the Austrian judiciary.
"The Croatian Justice Ministry should be the first institution to be informed about this, and it should then send us its opinion," County Prosecutor Rudolf Macek said, recalling that in March 2005 the County Prosecutor's Office had requested an investigation into Asner, and that the Justice Ministry had requested his extradition from Austria in September 2005.
Asner served as police chief in Pozega in 1941 and 1942 and is suspected of war crimes against civilians, mostly Jews and Serbs. Several witnesses have been questioned during the investigation into him.
"If it is established that Asner is too old and that he is unfit for trial, the investigation could be suspended, but the criminal proceedings could not, because there is no statute of limitations for war crimes," Macek said.
