Colak: There are no legal obstacles to cooperation between Bosnia and Serbia in prosecuting war crimes

BELGRADE, April 2 (Hina) - Bosnian Justice Minister Barisa Colak said in an interview with the Belgrade daily Vecernje Novosti of Monday that there were no legal obstacles to signing a protocol between Bosnia and Herzegovina and Serbia to prosecute perpetrators of war crimes, crimes against humanity and genocide, and that efforts were being made to ensure that the document was signed as soon as possible.

The protocol was to have been signed in Brussels in late November 2011, but its signing was cancelled at the request of the three members of the Bosnian collective presidency, who claimed that the procedure for signing bilateral agreements had been violated during the negotiations.

"I personally think that there are no legal obstacles to signing this protocol and that it would certainly improve international legal assistance between the two countries in prosecuting war crimes. Our position is clear here and we are doing all we can so that it is signed soon. I am also grateful to the European Commission for its contribution to the efforts that the protocol is signed as soon as possible," Colak said.

Colak said that Bosnia and Herzegovina had quite good cooperation with Serbia in providing international legal assistance in all areas except war crimes prosecution.

Speaking of cooperation in combating organised crime, Colak said that the two ministries of justice had already exchanged copies of the agreement on the extradition of citizens accused of organised crime, and that the necessary procedures had been launched to sign it. He said that the agreement would annul the benefit of dual citizenship for persons who abuse it to avoid criminal prosecution or serving prison sentences.
