ZAGREB, 12 Nov (Hina) - The Appeals Chamber of the International
Criminal Tribunal for Former Yugoslavia (ICTY), which is presided
over by judge Antonio Cassese, on Tuesday rendered a decision by
which it unanimously rejected the application of Slavko Dokmanovic
for leave to appeal the 'Decision on the Motion for Release by the
Accused Slavko Dokmanovic' and denied his motion for release.
On 22 October, the Trial Chamber refused Dokmanovic's motion for
release of 7 July, to which Dokmanovic filed an appeal on 31
October.
Although the Trial Chamber found that Dokmanovic's appeal had no
foundation, it still decided to consider it.
In the explanation of its final decision on Dokmanovic's appeal,
the Trial Chamber said that the argument by the accused that UNTAES
is not mandated to "kidnap and arrest" any person is "manifestly
ill-founded in fact and in law".
The allegation of the accused that the Trial Chamber erroneously
assumed that the Federal Republic of Yugoslavia would not execute
the arrest warrant against the accused is "manifestly ill-founded"
as well, the Trial Chamber statement said.
