ZAGREB, Feb 9 (Hina) - Croatia's Constitutional Court on Wednesday instigated proceedings to assess whether the law on ownership and other proprietary rights is in compliance with the Constitution. The Court annulled contended
provisions which stipulate that the consent the authorised minister gives to foreign individuals and legal entities for the acquisition of real estate on territory of Croatia should not be treated as administrative decisions. The Court regards that such consent is an administrative decision made by a body of the state administration in a administrative procedure by directly applying provisions of the law on ownership and other proprietary rights. Croatia's Constitution offers guarantees to everybody - Croatian citizens as well as to foreign subjects - that their rights and obligations will be decided on in legally conducted proceedings.(hina) ms
