ZAGREB, Nov 15 (Hina) - The Zagreb County Court said on Friday that before acting on demands from the UN war crimes tribunal at The Hague (ICTY) it would have medical experts establish if Gen. Janko Bobetko was capable of being served
with the indictment against him.

The investigating judge who has been entrusted with the Bobetko
case has decided on an expert medical examination as the medical
records enclosed in the file indicate that the 83-year-old
general's condition is bad, read a statement issued by Zagreb
County Court president Bozidar Rumenjak.
Under the constitutional law on Croatia's cooperation with the
International Criminal Tribunal for the former Yugoslavia (ICTY),
the competent county court is obliged to establish the existence of
legal or other obstacles to the execution of ICTY demands, said the
statement.
The Ministry of Justice forwarded the entire file in the Bobetko
case to the Zagreb County Court yesterday.
If the Zagreb County Court establishes that the indictment for some
reason cannot be served, it notifies the Croatian government, which
in turn notifies the ICTY Secretariat of the reasons why the
Tribunal's order that the indictment be served and the arrest
carried out cannot be executed. This is done in line with Article 59
of the Tribunal's Rules on Procedure and Evidence.
In that case, the ICTY may send its own team of doctors to check if
the defendant's condition prevents the execution of the Tribunal's
orders.
General Bobetko was hospitalised in Zagreb's Dubrava Clinic on
Thursday morning after his condition deteriorated.
