Under the ICTY Rules of Procedure and Evidence, in order to continue
the trial with a new member of the Trial Chamber in an advanced stage
of proceedings, as it is the case in the Milosevic trial, the
defendant's consent is required, otherwise there might be a retrial.
However, there is an exception to this rule, namely the trial may
continue even without the consent of the defendant should the trial
chamber decide that this is in the interest of justice.
