We received two decisions from Judge Alphonso Orie confirming and unsealing the indictment against Ivica Marijacic and Markica Rebic and the indictment against Stjepan Seselj and Domagoj Margetc for contempt of court, Landale said at a weekly press briefing.
Both indictments are connected to the publishing of the testimonies of protected witnesses and transcripts of their testimonies from closed sessions at the trial of Tihomir Blaskic in 1997 and 1998. The testimonies were published in Croatia in November 2004.
The ICTY regulations stipulate a penalty of up to seven years in prison and fine of up to EUR100,000 or a combination of the two for contempt of court.
Rebic is accused of revealing the identity of a protected witness to Ivica Marijacic, Hrvatski List editor in chief and giving him transcripts of Blaskic's trial from closed sessions.
Judge Orie has ordered the Prosecution to inform the ICTY Registrar within seven days of the whereabouts of the four indictees. He also requested of the Registrar to take all necessary measures so that the indictments be handed to the accused.
The Croatian Justice Ministry has not yet received the indictments against the four men, Assistant Justice Minister Jaksa Muljacic told Hina on Wednesday and added that the ministry expected ICTY representative in Croatia Thomas Osario to officially present the indictments to the ministry on Thursday.
