ZAGREB, Dec 11 (Hina) - The Zagreb County Court Penal of Judges on Monday quashed the decision on a temporary suspension of an investigation and the release of independent deputy Branimir Glavas from custody and ordered the
investigating judge in the case to ask for a new medical examination of the suspect and to establish whether the suspect was capable of following the criminal procedure launched against him, Zagreb County Court officials reported.
ZAGREB, Dec 11 (Hina) - The Zagreb County Court Penal of Judges on
Monday quashed the decision on a temporary suspension of an investigation and
the release of independent deputy Branimir Glavas from custody and ordered the
investigating judge in the case to ask for a new medical examination of the
suspect and to establish whether the suspect was capable of following the
criminal procedure launched against him, Zagreb County Court officials
reported. The Penal of Judges adopted the appeal of the prosecution
and sent the case back to Judge Zdenko Posavec, spokesman for the court
Kresimir Devcic said.
The Penal of Judges also requested that medical documents be collected
from the Osijek hospital, where Glavas is being treated after a hunger strike,
after he was released from custody on 2 December.
One of the attorneys for Glavas, Ante Madunic, said he expected the
team of doctors to confirm their opinion that Glavas is incapable of attending
the trial, and that judge Posavec would once again decide to discontinue the
investigation and release Glavas from custody.
The Zagreb State Prosecutor's Office suspects Glavas of the torture and
killing of non-Serb civilians in Osijek in 1991. At the end of October, an
investigation against Glavas was also launched in Osijek for the murder of
Osijek civilians in 1991.
