The head of the court's Criminal Department, Miroslav Sovanj, told Hina that the trial would most likely not start in the next "two or three months" because Judge Marin Mrcela, who had been awarded the case, had to study the case file and prepare for the trial.

"I don't think the trial will start before May," Sovanj said.

Generals Ademi and Norac are charged with war crimes committed against Serb civilians and prisoners of war during the 1993 Medak Pocket operation.

Sovanj presided over a panel of judges that rejected an objection to the indictment raised by Norac's defence attorney two days ago, when lawyer Zeljko Olujic said that the prosecution had failed to provide sufficient evidence against his client and recommended that the case should be returned for further investigation.

The court concluded that the objection was out of place because the indictment had become final.

According to the judges, the indictment became final on July 30, 2004 when it was confirmed by the Hague tribunal.

The case was referred to Croatia in September 2005.

The Hague tribunal's indictment was adjusted to Croatian legislation. Croatian prosecutors indicted the two generals based on evidence provided by the tribunal, without further investigation or the approval of an investigating judge, the Zagreb court said.
