ZAGREB, Jan 30 (Hina) - The Croatian Supreme Court has rejected the prosecution's appeal against the Zagreb County Court's ruling regarding the provisional release for generals Rahim Ademi and Mirko Norac.

The Zagreb County Court recently ordered precautionary measures for General Ademi, while Norac is already in prison where he is serving a 12-year term for war crimes committed in the Gospic area.

Ademi and Norac were indicted by the International Criminal Tribunal for the former Yugoslavia (ICTY) for war crimes committed during the Medak Pocket operation in the autumn of 1993. The ICTY decided in mid-September 2005 to refer the case to the Croatian judiciary after it found that all conditions for the referral had been met, including the protection of witnesses and a fair trial.

On 12 January this year, a Zagreb County Court panel of judges rejected the prosecution's request for the detention of Ademi and Norac. The prosecution had demanded their detention on account of the gravity of the crimes they are charged with.

The judges, however, warned Ademi that he must not leave his place of residence or tamper with witnesses and that he must report to the police every first Tuesday in a month. Norac, who is serving the prison term in the Glina penitentiary, was forbidden from contacting witnesses.

According to the decision which the Supreme Court issued on its website on Tuesday, this judicial institution believes that it can be expected that the indictees would comply with the measures.

The prosecution cannot appeal this decision.
