ZAGREB, Mar 1 (Hina) - The Croatian Constitutional Court on Wednesday annulled part of a regulation from the Law on Stamp Duties according to which a stamp duty of 1,500 kuna must be paid for certificates on Croatian citizenship by
all applicants, with the exception of those of Croat nationality. The proposal for annulling the controversial regulation was submitted by the Croatian Helsinki Committee. The Constitutional Court believes that the issue of stamp duties in procedures before the bodies of state authority can be part of the right to equal treatment in procedures, especially if in a procedure of acquiring the same right some applicants have to pay stamp duties and some are freed of that obligation. Wednesday annulled part of a regulation from the Law on Stamp Duties
according to which a stamp duty of 1,500 kuna must be paid for
certificates on Croatian citizenship by all applicants, with the
exception of those of Croat nationality. The proposal for annulling
the controversial regulation was submitted by the Croatian
Helsinki Committee.
The Constitutional Court believes that the issue of stamp duties in
procedures before the bodies of state authority can be part of the
right to equal treatment in procedures, especially if in a
procedure of acquiring the same right some applicants have to pay
stamp duties and some are freed of that obligation.
The Court also believes that the annulled regulation envisages
different treatment based exclusively on ethnicity, primarily of
members of the Croat people who do not have Croatian citizenship and
members of all non-Croat peoples and national minorities, which is
in contravention of the Constitution and the Convention on the
Protection of Human Rights and Basic Freedoms.
