Croatia demands in the request to the Appeals Chamber the
withdrawal of the decision confirming the indictment and its
amending, as well as the withdrawal of the arrest and hand-over
warrant.
The request includes all legally allowed objections to the content
and some parts of the indictment against Bobetko, reads the
statement.
The Government has sent the request acting in line with the
Constitutional Law on Cooperation Between the Republic of Croatia
and the International Criminal Tribunal for Former Yugoslavia
(ICTY) and its Statute and Rules on Procedure and Evidence, and
respecting deadlines.
Croatia's Ambassador to the Netherlands, Jaksa Muljacic, confirmed
that the government's request to the Appeals Chamber had been sent
in the form of a diplomatic note.
Although sources at the government have said that a request to
assess the constitutionality of the Hague indictment against
Bobetko would be sent to the Constitutional Court by the end of this
week, this did not happen by Friday afternoon.
Government sources said the request could be forwarded next week.
A team of legal experts has been working on the request.
