CROATIAN-SWEDISH CONSORTIUM FILES LAWSUIT OVER REJECTED BID

ZAGREB, Nov 25 (Hina) - The Croatian-Swedish consortium "Treca sreca"(Third Time Lucky), whose bid for the third mobile telephony operatinglicence in Croatia was rejected recently, has filed a lawsuit with theAdministration Court seeking the annulment of the decision of theCouncil of the Croatian Agency for Telecommunications and the grantingof the operating licence.
ZAGREB, Nov 25 (Hina) - The Croatian-Swedish consortium "Treca sreca" (Third Time Lucky), whose bid for the third mobile telephony operating licence in Croatia was rejected recently, has filed a lawsuit with the Administration Court seeking the annulment of the decision of the Council of the Croatian Agency for Telecommunications and the granting of the operating licence.

The request for the annulment of the Council's decision was also forwarded to the Ministry of the Sea, Tourism, Transport and Development and the Telecommunications Agency.

The consortium claims that it met all conditions of the tender and that it should have been awarded the operating licence.

If Croatian institutions fail to take steps to correct what it claims is an unlawful decision, the consortium will seek justice through international arbitration.

The consortium claims that the decision could have negative consequences for the process of Croatia's integration with the European Union and proposes an independent evaluation of the bidding procedure and consultations with EU telecommunications experts.

It also states that the complete lack of transparency of the Agency's decision to turn down its offer has prompted it to inform the EU's directorates for information society and enlargement of the case.

The incumbent enlargement commissioner Ollie Rehn, who is visiting Croatia today, headed the directorate for information society at the time the complaint was submitted and is familiar with the problem, the consortium said.

The Ministry of the Sea, Tourism, Transport and Development and the Telecommunications Agency have said they received the consortium's request and will consider it as soon as possible.
