Ortynski lodged the complaint as he feels the parliamentary decision
violates his right to work. He has said that instead of relieving him
of his duties at his own request for personal reasons, which would
have enabled him to take up office as a deputy state prosecutor,
parliament fired him for "other, unspecified reasons", leaving him
jobless.
The Constitutional Court rejected Ortynski's complaint with a majority
vote on Wednesday with the explanation that he did not file an
administrative suit, thus failing to use the legal means at his
disposal.
Parliament dismissed Ortynski on 24 April 2002 under Article 55 of the
Law on the State Prosecutor's Office, which refers to dismissal due to
failure to exercise one's authority. The week before parliament
rejected Ortynski's report on the performance of his office.
Concluding his presentation of the report in parliament, Ortynski said
that he was being "replaced by organised crime which has its people in
politics, the judiciary, among lawyers, the media".
