Another two witnesses from Serbia testify in Lora war crimes trial

SPLIT, Oct 25 (Hina) - Two witnesses, former members of the Yugoslav People's Army (JNA) and former inmates in the Lora military prison, testified before the County Court in the Croatian coastal city of Split in the trial against eight former Croatian military policemen.

The witnesses, Milance Tosic and Nenad Filipovic, who are citizens of Serbia-Montenegro, said they had been tortured in the prison. Filipovic added that he had no knowledge about the torture of civilians in that prison.

Tosic, who was captured during the war in Bosnia-Herzegovina, said that during his four-month imprisonment in Lora his interrogators had run electricity through him, beat him, stubbed out cigarettes on him, and forced him to sing Croatian nationalist songs.

During today's discussion Tosic recognised two indictees, Ante Gudic and Andjelko Botic, as those who had abused him.

He also said that the principal indictee, Tomislav Duic, a former commander of the Lora prison now on the run, tied a prisoner to a radiator and beat him with a baseball bat, but that Duic had not abused him.

Tosic went on to say that out of fear he had not told Red Cross representatives who were on a visit to the prison about the torture and that he had told them that Croatian soldiers were treating prisoners well.

Asked how come the Red Cross observers believed him if they saw him beaten and with bruises, Tosic said that he and other prisoners lied that they had fallen and that wasps had stung them.

Ankica Luetic, the lawyer for Emilio Bungur who is also on the run, responded then that "we don't know what the truth is. If you lied to the Red Cross, how can we know that you are not lying at this trial?"

The second witness, Nenad Filipovic, was imprisoned in Lora for one day after he was captured on a battlefield near the eastern Croatian city of Vinkovci.

"I will never forget that day as I was beaten in my cell with batons and baseball bats until I fell on the floor and started begging for mercy," he said.

He recognised indictee Davor Banic as his abuser, and added that at that time Banic was called in prison by the nickname "Bokser (Boxer)"

The lawyer for Banic, Vinko Ljubicic, said that Filipovic could not have been abused by his client on that day, 3 April 1992, as Banic was not on duty in prison. Banic said he was on the front at that time.

As regards a person nicknamed Boxer, lawyer Ljubicic said that there was evidence that this was not Banic but another man.

The hearing of prosecution witnesses from Serbia-Montenegro continues tomorrow.
