OSIJEK, Oct 24 (Hina) - The Osijek County Prosecutor's Office has lodged an appeal against the ruling by the Osijek County Court declaring itself as not having territorial jurisdiction over conducting an investigation and deciding on detention independent member of Parliament Branimir Glavas.

The Prosecutor's Office said on Tuesday there were grounds under the Law on Criminal Procedure that proceedings should be conducted before the Osijek County Court, which had launched an investigation and ordered detention for six suspects in the so-called Sellotape case, in which Glavas is also a suspect.

Osijek County Court investigating judge Mario Kovac issued the ruling on Monday evening, explaining that the Zagreb County Court had already initiated criminal proceedings against Glavas for the same crime.

"We believe that those proceedings should be joined because they relate to the same crimes, while the proceeding against Glavas being conducted in Zagreb relates to another matter, notably the so-called Garage case," Zvonko Kuharic, a spokesman for the Osijek County Prosecutor's Office, told Hina.

Last night the investigating judge said that the court proceedings against Glavas "are identical, because they are about the same war, the same location where crimes were committed, namely the city of Osijek, and since a proceeding is already under way before the Zagreb County Court, a court proceeding against Glavas should continue there," Kuharic said, adding that the disputed situation would be resolved by a panel of judges at the Osijek County Court.

The defence team representing Glavas said on Tuesday they had received the Osijek County Court ruling. "The deadline for filing an appeal expires on Friday, by which time we will have considered whether we will lodge an appeal or not," lawyer Marko Dumancic said.
