A three-member trial chamber presided by Judge Bakone Justice Moloto decided today to order the prosecution to investigate how and why HTV published in its May 28 prime time news broadcast parts of the classified document "Clarification of Indictment" regarding the case against Croatian generals Ante Gotovina, Mladen Markac and Ivan Cermak, including the names of seven Croatian nationals who are mentioned in the context of the "criminal enterprise".
The trial chamber on Thursday declassified the document "Clarification of Indictment" in which the prosecution, among other things, two weeks ago listed by name Mirko Norac, Rahim Ademi, Miljenko Crnjac, Mato Lausic, Ivan Jarnjak, Markica Rebic and Jure Radic, but HTV published parts of the document, including the names of the seven persons, while the document was still confidential.
Explaining its decision, the trial chamber said that HTV and other media continued to publish confidential information and that the source of the information was still unknown, as well as that persons responsible for such a serious violation of rules on the publishing of confidential information, who knowingly violated their confidentiality status, could be punished for contempt of court in line with the ICTY's Rules of Procedure and Evidence.
