"There was no agreement on the joint criminal enterprise on Brijuni on 31 July 1995 when (the leadership) planned the liberation of the occupied areas," lawyer Gregory Kehoe said today.
He said that participants in the Brijuni meeting as well as in other meetings of the political and military leadership discussed how to prevent criminal offences during and after the military offensive.
He cited several meetings involving Defence Minister Gojko Susak, Interior Minister Ivan Jarnjak, Military Police Commander Mate Lausic and others who insisted on the prevention of plunder and arson attacks after the operation.
Lawyer Luka Misetic asked that counts of the indictment for his client's command responsibility should be dropped as well as counts referring to Gotovina's responsibility for the murder of Serb civilians during the operation.
Misetic said that Gotovina had on many occasions issued orders for the prevention of plunder and arson and for the punishment of undisciplined Croatian troops.
The lawyer added that Gotovina could not have known that his orders had not been implemented on the ground.
